Immigration Language Interpreter Training & Dealing With ICE

 

Immigration language interpreter training becomes more important with each new ICE detention center that gets built. For the bilingual adults wanting to help, they often ask "if my friend gets detained by ICE and doesn't speak English well, can I become a language interpreter for them?" The short answer is: sometimes. Because most immigration proceedings involving ICE require professionally trained immigration interpreters. The reality is that without immigration interpreter training, language barriers make stressful situations frightening. Even more important still: the friend you care about has the right to an immigration language interpreter. Here's what you should know...

 

"If someone who can't speak English well gets detained by ICE can I be their language interpreter?" The short answer is: sometimes.

 

Without immigration language interpreter training:

According to the U.S department of homeland security- without official language interpreter training- Immigration and Customs Enforcement (ICE) will allow bilingual adults to provide language assistance in the following scenarios:

During arrest & initial detention: only informally and only if ICE agents allow it. More often than not, it is safer for your friend to request a lawyer and remain silent as anything they say can be used against them.

At USCIS interviews: but this is up to each officer's discretion, as you can become disqualified if you are believed to be incompetent or impartial with language assistance.

 

Bilingual adults without immigration language interpreter training can attempt to help with communication. Rather than asking if you can do it bilingual adults really ought to be asking if they should help in the first place. Before you step in, it is important to know the answers to these questions:

  1. What specific situation are you providing assistance with (interview, talking with a lawyer, reading court documents etc)?

  2. Do you have legal status within in the United States, yourself?

 

Informal language interpreting can do a lot of damage to someone's immigration case and harm the perception of neutrality. In fact, it can even put you at risk too. Here's some essential immigration terminology to know if you find yourself helping someone understand documents or communicating with a lawyer:

• A-Number: A 9-digit Alien Registration Number that gets assigned to noncitizens.

• Bond: the amount of money a person has to pay to released from detention, which will guarantee that they show up for court proceedings.

• Notice To Appear (NTA): a physical document that begins the deportation process, outlining the justification for removal.

• Master Calendar Hearing: A brief hearing where a judge schedules future court dates, where the respondent enters a "plea."

• Individual Calendar Hearing: The final trial where a person presents their full case for asylum.

• Entry Without Inspection (EWI): Entering the United States without going through an official port of entry.

How to help with immigration interpreter training:

In all reality, the most helpful thing you can do for your friends detained by ICE is to become an immigration language interpreter yourself. By giving yourself the instruction and the preparation required, you are reducing harm for the people you want to help. Whether you actually made a mistake or not doesn't matter... if you provide language assistance without proper training, all someone has to do is suspect that you made a mistake for there to be consequences.

Because even though your heart might be in the right place, your loved ones will have to pay the consequences for mistakes (real or not).
